Terms of Service
These Terms govern your use of the Oops I'm Late! mobile application (the "App") published by Alex Reich. By installing or using the App you agree to these Terms. If you don't agree, don't use the App.
1. The service
The App helps you notify recipients when you are running late to a calendar appointment. It uses your device's calendar, GPS, and contacts — and, if you subscribe to a paid tier, an off-device traffic ETA proxy.
2. Subscriptions and billing
- Subscriptions are billed by the Apple App Store or Google Play and managed by the store. Cancellation must happen in your store account.
- Paid tiers offered: Basic (unlimited destinations and contact groups, series templates) and Pro (traffic-aware ETA, CarPlay and Android Auto). Pricing is shown in-app at point of purchase.
- All purchases are final to the extent permitted by the applicable store; refunds are at the store's discretion.
- A free tier is available with on-device-only ETA and a 3-destination limit.
3. What you must not do
- Use the App to deceive recipients about your real location or arrival time.
- Use the App to harass, stalk, or surveil any person.
- Reverse-engineer, decompile, or extract source code from the App beyond what applicable law permits.
- Resell, sublicence, or redistribute the App.
- Interfere with our servers, including the traffic ETA proxy, in a way that degrades service for others (rate limit evasion, automated scraping, etc.).
4. Accounts and authentication
The App does not require an account today. Anonymous install identifiers are used for proxy authentication and entitlement lookup. If we add accounts in the future, additional terms will apply at sign-up.
5. Privacy
Use of the App is governed by our Privacy Policy, which is incorporated by reference.
6. Third-party services
The App relies on services we don't operate:
- Apple App Store and Google Play (purchases, receipts).
- RevenueCat (subscription validation).
- Sentry (optional crash reporting).
- Google Routes API via our proxy (optional traffic-aware ETA, Pro tier).
These services have their own terms; your use of them is subject to theirs.
7. Disclaimers
The App is provided "as is" without warranty of any kind. We do not guarantee that notifications will be delivered on time, that ETA estimates will be accurate, or that the service will be uninterrupted. We don't accept responsibility for outcomes resulting from late notifications, missed appointments, GPS inaccuracy, or carrier-side SMS delivery issues.
8. Limitation of liability
To the maximum extent permitted by law, our aggregate liability arising from your use of the App is limited to the amount you paid us in the twelve months preceding the claim. We exclude liability for indirect, incidental, consequential, special, or punitive damages.
9. Changes to these Terms
We may update these Terms. Material changes will be surfaced in-app on next launch and the "Effective date" updated. Continued use after a change means you accept it.
10. Termination
You can stop using the App at any time. We may suspend or terminate access if you breach these Terms or attempt to interfere with the service.
11. Governing law
These Terms are governed by the laws of California, USA, excluding conflict-of-laws rules. Disputes will be resolved in the state or federal courts in Los Angeles County, California, subject to any rights you have under applicable consumer protection law.
